Ferme woorden van de premier. Als het strafrecht niet voldoet om ‘de onbestaanbare en walgelijke uitspraken’ over homo’s en vrouwen aan te pakken, dan moet de wet worden aangepast. Dit was de uitkomst van het overleg in de ministerraad afgelopen vrijdag over de boeken die in de Amsterdamse El Tawheed-moskee worden verkocht.

Volgens mij biedt artikel 137e van het Wetboek van Strafrecht soelaas. Dit artikel stelt het strafbaar om uitlatingen openbaar te maken (of voorwerpen met zulke uitlatingen ter verspreiding in voorraad te hebben) als deze beledigend zijn voor (o.a.) homoseksuelen ofwel als deze aanzetten tot haat, discriminatie of gewelddadig optreden tegen een groep mensen wegens (o.a.) hun homoseksuele geaardheid of sekse. Dus de lat om de vrouwonvriendelijke passages aan te pakken ligt iets hoger dan bij homo’s, maar dat het strafrecht aanknopingspunten biedt staat vast. Saillant detail* is dat artikel 137e onderdeel uitmaakt van een rijtje anti-discriminatiebepalingen die een tijdje terug zwaar onder vuur lagen omdat zij het maatschappelijk debat zouden verlammen. Fortuyn heeft mij via Jomanda doorgestraald dat hij die artikelen op het oog had toen hij zijn beruchte pleidooi hield voor het afschaffen van artikel 1 van de Grondwet (zie ook A. Soeteman). Met name artikel 137c, waarin belediging van enkele groepen strafbaar is gesteld, zou geschrapt moeten worden om de politieke correctheid volledig te kunnen overwinnen. Erik van Ree pleitte begin 2002 voor vervanging van alle 137-artikelen door het op Amerikaanse leest geschoeide ‘clear and present danger’-beginsel, waarbij discriminerende of haatdragende uitlatingen pas strafbaar zijn als zij, gezien de omstandigheden waarin zij zijn gedaan, geacht worden te leiden tot geweldadige acties tegen de gediscrimineerde groepen.
